The problem with this is that it is not always clear who should pay for this, or how the amount should be divided after the property has been sold during the year.<\/p>\n<p style=\"text-align: justify;\">For this reason it is not strange that both buyer and seller share the same question: Who pays for the IBI the first year after transferring a property? Today\u2019s article by <a href=\"https:\/\/www.shmadrid.com\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>ShMadrid<\/strong><\/a> shines a light on the subject.<\/p>\n<p style=\"text-align: center;\"><em>Related article:\u00a0<a href=\"http:\/\/www.shmadrid.com\/blog\/en\/real-estate-trends-2020\/\" target=\"_blank\" rel=\"noopener noreferrer\">3 Real Estate Trends in 2020<\/a><\/em><\/p>\n<h2 style=\"text-align: justify;\">Who should pay for the IBI, previous or current owner?<\/h2>\n<p style=\"text-align: justify;\">The <strong>Supreme Court<\/strong> answered the question quite clear in its ruling 406\/2016 of June 15. The jurisprudential entity decided that whoever is selling the property, must pay the IBI. So if there is no agreement that says otherwise, the seller should take care of the payment.<\/p>\n<div id=\"attachment_10907\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/www.shmadrid.com\/blog\/en\/wp-content\/uploads\/2020\/03\/ibi_opt.jpg\"><img aria-describedby=\"caption-attachment-10907\" loading=\"lazy\" class=\"size-full wp-image-10907\" src=\"http:\/\/www.shmadrid.com\/blog\/en\/wp-content\/uploads\/2020\/03\/ibi_opt.jpg\" alt=\"living room\" width=\"640\" height=\"427\" srcset=\"https:\/\/www.shmadrid.com\/blog\/en\/wp-content\/uploads\/2020\/03\/ibi_opt.jpg 640w, https:\/\/www.shmadrid.com\/blog\/en\/wp-content\/uploads\/2020\/03\/ibi_opt-300x200.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/a><p id=\"caption-attachment-10907\" class=\"wp-caption-text\"><em>Photo via Pixabay<\/em><\/p><\/div>\n<p style=\"text-align: justify;\">It is, however, possible to claim a part from the buyer, and this part should then represent the amount of time the new owner has been able to enjoy the <a href=\"http:\/\/www.shmadrid.com\/blog\/en\/rent-out-property-madrid\/\"><strong>property<\/strong><\/a>. This is the only way, besides to what the Supreme Court has decided, to settle an agreement on the Property Tax.<\/p>\n<p style=\"text-align: justify;\">It seems only fair and logic that a seller and buyer can agree on the corresponding tax to be paid together, without having to sign an extra document for it. As a result, the IBI will be shared by both parties, in accordance with the specific amount of time that they were the owner of the property during that year.<\/p>\n<p style=\"text-align: justify;\">The ruling of June 15, 2016 states that, when in doubt, the seller will be directly liable for paying the <a href=\"http:\/\/www.shmadrid.com\/blog\/en\/itp-tax\/\"><strong>tax<\/strong><\/a>. It does, however, provide him with the opportunity to go to court to get compensation for the part of the year he wasn\u2019t owner of the property anymore.<\/p>\n<p style=\"text-align: justify;\">So in the end, the seller can request for the buyer to pay for the corresponding part of the IBI, which will be the number of days that are left in the year, unless they agreed differently.<\/p>\n<p style=\"text-align: center;\"><em>Related article:\u00a0<a href=\"http:\/\/www.shmadrid.com\/blog\/en\/advantages-renovated-apartment-madrid\/\">Advantages of Buying a Renovated Apartment in Madrid<\/a><\/em><\/p>\n<p style=\"text-align: justify;\">If you are planning on <a href=\"http:\/\/www.shmadrid.com\/blog\/en\/buy-home-centre-madrid\/\"><strong>buying<\/strong><\/a> a property, make sure the specifics of the payment of the IBI are clear before your appointment at the notary. And if you are the seller, do exactly the same. If the seller is paying for the IBI, he can decide on claiming the days he is no longer <a href=\"http:\/\/www.shmadrid.com\/blog\/en\/decisions-buying-property\/\"><strong>property<\/strong><\/a> owner from the buyer.<\/p>\n<p style=\"text-align: justify;\">An interesting fact is that not all properties are subject to paying IBI.
